Lefkothea Nteka, Partner, Head of our Antitrust & Competition practice, was invited to speak at the Mergers and Acquisitions Economics & Law Forum, organised by CLEON Conferences, on 28 September 2022. Lefkothea referred to the Illumina/Grail case and discussed merger control considerations when designing M&A. In particular, she identified the increasing number of instances where a notification is necessary when implementing M&A, in the context of either merger control regimes (standard obligation to notify, Article 22 EUMR, mergers under the thresholds) or screening mechanisms for foreign direct investments (FDI) and foreign subsidies. She further discussed risks and practical solutions to face the growing number of ‘stop-the-clock’ instances when designing and implementing M&A
