Decision No 509/1/11.09.2020 of the Hellenic Gaming Commission (HGC) has been issued re “Granting Appropriateness License of Affiliates”, as published in the Government Gazette (B’ 4140/28.09.2020).
Background
Following the Greek Parliament voting the new Development and Strategic Investment legislation (Law 4635/2019), which included, amongst others, a number of long-awaited amendments as regards betting and gaming in Greece, verifying thus the ascension of a new gambling legislative which is part of measures aiming at improving the country’s economy, the HGC has announced the opening of the procedure re online gaming licensing and has invited all interested parties to submit their applications. In the above context, the HGC has further issued its Decision regulating the Affiliates regime henceforth.
Defining “affiliates”
According to the Decision, an affiliate is considered an individual/legal entity which possesses an appropriateness License issued by the HGC, has been registered to the respective HGC’s Register and cooperates with the (Online Gaming) License Holder in order to promote specific online games of chance through the affiliate’s website in order to attract players to join the License Holder’s website.
The Affiliate’s remuneration must depend on the number, the participation and the general activity of the Players attracted through its promotional actions.
The Affiliates are obliged to have concluded a “Cooperation Agreement” with the License Holder in order to provide said services. This Agreement must include, at least, the duration and object of the agreement, the domain names and websites to be used by the Affiliate for the promotion of the License Holder’s gaming activities and services, the amendment proceedings of the agreement, termination provisions, remuneration provisions, dispute resolution proceedings and the Affiliate’s explicit consent to comply to all Regulations and Guidelines of HGC, as in force.
General rules
The exchange and management of files and documents between the HGC and the Affiliate shall be taking place electronically. In this respect, the Affiliate must hold an e-signature.
When examining the Affiliate’s petition to be granted an appropriateness License, the HGC may request from the petitioner or any other public or private authority any data or documents which are deemed necessary for HGC to reach its verdict.
Affiliates with registered seats abroad must produce all the respective documents promptly notarized and translated in Greek.
Affiliates are prohibited from providing services to entities which do not hold a lawful license of providing online gaming services in Greece.
Last but not least, all Affiliates must comply to the Responsible Gaming Regulations, as in force.
Granting of Appropriateness Licenses to the Affiliates
In order to be granted a License, the Affiliates must file a respective petition before the HGC.
The petition must include several documents, such as CVs, list with the domain names and websites to be used by the Affiliate, WHOIS certificates of the respective domain names, tax certificates re initiation of commercial activities, commercial registry certificates, solemn declarations that the Affiliate or the Affiliate’s representatives have not been convicted for several crimes and have not been declared bankrupt etc.
In order to be registered in HGC’s Affiliates’ Register, the Affiliate must deposit a fee of EUR 1,000.
Any amendments to the Affiliate’s status must be notified to the HGC within 20 days from their taking place.
